Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you and FoodDelivery concerning your access to and use of our website and mobile application. By accessing or using our services, you agree that you have read, understood, and agree to be bound by these Terms.

If you do not agree with all of these Terms, then you are expressly prohibited from using our services and you must discontinue use immediately.

Use of Services

Eligibility

You must be at least 13 years old to use our services. By using our services, you represent and warrant that you meet this age requirement. If you are under 18, you may only use our services with the involvement and consent of a parent or guardian.

Account Registration

To access certain features of our services, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

Orders and Payments

Placing Orders

When you place an order through our platform, you are making an offer to purchase the items in your order. All orders are subject to acceptance by the restaurant. We reserve the right to refuse or cancel any order for any reason.

Pricing

Prices for menu items are set by individual restaurants and are displayed in the app. Delivery fees, service fees, and applicable taxes will be added to your order total. All prices are subject to change without notice.

Payment

You agree to pay all charges incurred by you or on your behalf through the service, at the prices in effect when such charges are incurred. You will provide valid payment method information, and you authorize us to charge such payment method for the total amount of your order.

Delivery

Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by circumstances beyond our control, including but not limited to traffic, weather conditions, or restaurant preparation times.

You are responsible for providing accurate delivery information. If a delivery cannot be completed due to incorrect information, additional fees may apply for re-delivery.

Cancellations and Refunds

Orders may be cancelled before the restaurant has begun preparation. Once preparation has started, orders cannot be cancelled. Refunds are issued at our discretion and are typically processed within 5-7 business days.

If you receive an incorrect or damaged order, please contact customer support immediately. We will work with you to resolve the issue, which may include a refund or replacement order.

User Conduct

You agree not to:

  • Use our services for any illegal or unauthorized purpose
  • Violate any laws or regulations in connection with your use of the services
  • Impersonate any person or entity or falsely state or misrepresent your affiliation
  • Interfere with or disrupt the services or servers or networks connected to the services
  • Attempt to gain unauthorized access to any portion of the services
  • Upload viruses or other malicious code or otherwise compromise the security of the services
  • Harass, abuse, or harm another person or entity

Intellectual Property

The services and their entire contents, features, and functionality are owned by FoodDelivery and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the services without our prior written consent.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

We are not responsible for the quality, safety, or legality of the food items ordered through our platform. Each restaurant is an independent third party responsible for preparing and ensuring the quality of their food.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FoodDelivery BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICES.

Indemnification

You agree to defend, indemnify, and hold harmless FoodDelivery and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the services, your violation of these Terms, or your violation of any rights of another party.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the services shall be subject to the exclusive jurisdiction of the courts located in San Francisco, California.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the services after such changes constitutes your acceptance of the new Terms.
